How do I evict a tenant?

An eviction is a civil matter handled at County Court. The Hollywood Police Department offers a Landlord Workshop to assist property owners in avoiding problems with their properties and tenants. The information presented at these workshops is extremely valuable to landlords. Some items to be discussed are:

1. How do I report a crime?: Dial 911 for emergencies. For non-emergencies, call 954.764.4357.

2. How can I report a fraud or identity theft?: If you or someone you know has been the victim of fraud or identity theft in the City of Hollywood, the Hollywood Police Department encourages you to visit its Economic Crimes Unit at the HPD West Network Center, 1109 North 69 Way in Hollywood. 3. Can I claim lost property that I found?

With regard to "Found Property," if the rightful owner cannot be found, pursuant to Florida State Statute 705.102, the citizen who found the item has the option to make a claim to the property.

If the citizen wishes to make a claim, the citizen will be instructed that within three business days they must:

1. Place the Department on notice by contacting the Department's Property and Evidence Unit.

2. Pay a $25 deposit to the Department's Central Records to cover the cost of transportation, storage and publication notice. Such deposit will be reimbursed to the citizen by the rightful owner if they reclaim the property.

5. What will happen to my case after I make a report?: In most misdemeanor cases where the victim wants to prosecute, the victim follows up with the State Attorney’s Office to file charges. They are located at 201 S.E. 6 Street Fort Lauderdale, Florida.
In felony cases, the Probable Cause Affidavit, reports and statements are forwarded by the Hollywood Police Department’s Case Filing Unit to the State Attorney’s Office. The State Attorney’s Office determines which cases they will prosecute.

6. How can I get a copy of a police report?

Florida State Statute 119 governs the Public Records Law. Reports can take up to 10 business days for availability.

Copies of police reports can be obtained at the Police Departments Records Section located at 3250 Hollywood Boulevard. They are open Monday through Friday from 8:00 am to 4:30 pm excluding holidays and weekends. The cost of a police report is $.15 cents per page, or 20 cents for a double sided copy. Certified copies of reports are $1 per page. If extensive research is needed to complete a request, additional fees will apply.

Only those individuals involved in a crash, or their agent can obtain a copy of the crash report within 60 days of the crash date. An affidavit will be required to obtain such report.

7. What do I do if a report is incorrect?: If your report contains inaccurate information, the Officer that handled the original incident is the only one that can make changes to the report.

8. Where do I obtain a final disposition of a case?: Contact the Broward County Clerk of the Court 954.831.7154.

9. How do I contact the officer that handled my report?: Officers work various hours. Please leave them a message for them at 954.967.4636.

10. Will a detective follow up on my case?: A detective will be assigned to almost all felony cases and domestic violence misdemeanors.

13. How do I file a report about something that is not criminal in nature?: Civil cases are filed in county court.

17. What time does the noise ordinance go in effect?: There is no specific time indicated in the ordinance. If noise is disturbing the peace, the ordinance is enforceable, as long as the complainant signs a complaint affidavit.

19. How can I find out if someone was arrested?: To conduct an arrest search in Broward County, visit the Sheriff website.

20. Where can I get a restraining order?: Restraining Orders can be filed at the Broward County Court House located at 201 S.E. 6 Street, Fort Lauderdale Florida.

21. How long do I have to wait before reporting a person missing?: A specific criterion has to be met before a person is categorized as a Missing Person. There is no specified time frame that one has to wait to file a Missing Person report.

22. What happens to unclaimed property?: Found items are considered abandoned after 90 days and are subject to destruction, donation to charity, or auction. Items to be auctioned are submitted to aPolice auction website, which handles all aspects of the auctions, including the terms, rules, bidding arrangements, and shipping policies.
Evidentiary items related to crimes other than capital felonies will be disposed of after the final disposition of the courts; as outlined within the Florida State Statutes relating to evidence retention.

23. How do I get my property back that is being held by the Hollywood Police Department?

Please call the Property section at 954.967.4620 to confirm that we have your property and that it is available for release. Appointments are recommended and in some cases required. You will need your case number and photo identification. In some cases other documentation is required.

You may assign another person to retrieve your property with a notarized letter of authorization and photo identification. The letter must be addressed to the Hollywood Police Department Property Unit and include:

The name of the person you are granting this authority

24. How do I make a complaint against an employee of the Police Department?

The Hollywood Police Department has created a Complaint Brochure to inform Hollywood residents and visitors of the process of making a complaint. The brochure is also available in Spanish, French and Creole. These brochures are also available at the Police Department's Headquarters.

Complaint Process:
All complaints will be accepted by the Internal Affairs Unit and can be received in person, by letter, by complaint form, by telephone, or by e-mail. Anonymous complaints are also accepted. The Office of the Chief of Police will review all complaints and a determination will be made to assign the complaint to the appropriate Division Major or the Internal Affairs Unit for investigation. Following a thorough and impartial investigation, a disposition will be rendered based on all available factual information. The complainant will be contacted at the completion of the investigation, and will have an opportunity to discuss the disposition of the complaint.

Step 2: Complaints can be documented on a Complaint Intake Form. Forms are located in the lobby of Police Headquarters.

Step 3: Completed Complaint Intake Forms may be hand-delivered to any On-Duty Supervisor, hand-delivered to the Public Information Desk in the lobby of Police Headquarters, mailed or faxed to the number included on the Complaint Intake Form, or emailed to IA@hollywoodfl.org.

Step 4: You may at any time speak with an On-Duty Supervisor to initiate a complaint on any Member of the Police Department by contacting 954.764.4357.

Step 5: Upon receipt of the complaint, you will be contacted by the investigating Supervisor or the Internal Affairs Unit. At this step you may be requested to provide a sworn statement(s), produce any evidence of allegations and/or discuss the complaint in detail.

31. Do you provide fingerprint services?: Fingerprints are available Tuesdays and Wednesdays from 8:00 am to 10:30 am Fingerprint cards must be brought in by the requester. The cost for fingerprinting services is $10 for City of Hollywood Residents and $15 for Non- Residents.

32. Where can I get a background check?

A local background check for incidents which occurred in the City of Hollywood is available at Police Departments Records Section located at 3250 Hollywood Boulevard. They are open Monday through Friday from 8:00 a.m. to 4:30 p.m. excluding holidays and weekends.

Countywide background checks are available at 2600 Broward Boulevard. Their contact number is 954.831.8700.

A Level II background check is available through the Federal Bureau of Investigations. Their contact number is 754.703.2000.
